These Terms and Conditions, together with the Privacy Policy and Cookie Policy, constitute the agreement between FIMA MOTORS S.R.L. and you, the renter, for car rental services and apply to all our contracts for the services provided. By continuing to browse this website, you automatically accept the terms of use described below.
FIMA MOTORS S.R.L. reserves the right to modify these terms and conditions periodically. We recommend checking our website regularly for any updates. If you, the renter, do not agree with any of our rental terms or conditions, you should not continue using this site. By confirming your car reservation through our website, whether online or by phone, you acknowledge that you have read, understood, and accepted these terms, conditions, and privacy policy.
By entrusting you with a vehicle, we enter into a rental agreement under the contractual terms and conditions detailed below, subject to force majeure, as stipulated by Romanian law. Car rentals offered through this website are governed by standard rental agreements, which you will need to complete when picking up a vehicle. Renters must carefully read and confirm their acceptance of all specified terms and conditions by signing the Rental Agreement. The client must comply with all terms outlined in this contract. Any deviations from these terms require prior written approval from the company.
The terms used in this document are interpreted according to applicable rental contract laws.
"You," "User," or "Client" refers to the driver and the person(s) making the payment, as stated in the rental contract.
"We" or "the Company" refers to FMN Rent a Car Romania.
"Vehicle" refers to the rented car or utility vehicle, as agreed in the rental contract.
"Damage" includes any deterioration of the vehicle, including damage to glass components such as windows, mirrors, and lights.
"Theft" refers to the theft of the vehicle, vandalism, stolen accessories, or attempted theft.
"Traveling abroad" means crossing Romania’s borders. This is generally prohibited. You may travel outside Romania only with prior written authorization from FMN Rent a Car, which must be requested at least two days in advance (excluding weekends).
To rent a vehicle, you must provide valid documents, including your identity card or passport, proof of address, driver’s license details, and a valid payment method.
The driver must hold a valid driver's license for at least 12 months for the category of the rented vehicle.
The driver must be at least 21 years old (some vehicle categories may require a higher minimum age).
Photocopies, temporary driving permits, or expired licenses are not accepted.
The primary driver must present a valid credit card. The card details will be taken at the time of rental or added during the booking process to speed up the rental process.
Typically, rental vehicles are insured only for the renter. If additional drivers will operate the car, they must be present at the time of rental and added to the rental contract. They must also provide a valid driver's license held for at least one year and meet the minimum age requirements.
Identity card or passport
Valid driver’s license (held for a minimum of 12 months)
Additional documents may be requested at the rental office if necessary (e.g., return flight ticket, accommodation confirmation, etc.).
If there is an additional driver, they must provide an identity document (ID/passport) and a valid driver’s license. The additional driver must be present when picking up the vehicle to be registered in the rental contract
Payment:
At the beginning of the rental, you will be required to make a payment equal to the invoice amount for the rental, plus the corresponding deposit.
Regardless of the payment method used, the company reserves the right to conduct any necessary checks and approve or refuse the rental. The rental cost is calculated in Euros. Any payment made in other convertible currencies is calculated based on the current exchange rate of Unicredit Bank.
The deposit amount depends on the category of the rented vehicle and the insurance options waived. This deposit is intended to cover damages or theft of the vehicle. The specific amount will be indicated in the rental contract at the time of rental.
If the user is not exempt from the damage and/or theft fee, the deposit will serve as the maximum security amount, depending on the category of the vehicle provided, as specified in the rental contract.
The deposit covers potential damage caused by the renter or vehicle theft (subject to contractual exemptions detailed below) and serves to compensate for incurred losses.
If no damage and/or theft occurs, the deposit will be refunded at the end of the rental period.
Cancellation Policy for a Confirmed and Prepaid Reservation
A reservation prepaid via bank transfer or card (VISA, MASTERCARD) on this website can be canceled under the following conditions:
If the car pick-up date and time are more than 24 hours from the cancellation time, the full prepaid amount will be refunded to the client’s account (within a maximum of 30 business days), MINUS 20 Euros. The 20 Euros represent bank fees and logistical costs related to the rental.
If the car pick-up date and time are less than 24 hours from the cancellation time, the prepaid amount is NON-REFUNDABLE. However, the client will receive a credit voucher for the full amount, which can be used for a future reservation.
If the CLIENT wishes to cancel the reservation and keep the prepaid amount for a future booking, this can be arranged by issuing a credit voucher.
All cancellations of prepaid reservations via bank transfer must be communicated in writing to [email protected].
Vehicle Pickup and Drop-off:
Our staff will deliver and pick up the vehicle at any time of the day or night in Bucharest and at Otopeni Airport (Henri-Coanda).
Vehicle Condition:
A document describing the vehicle's condition is attached to the contract. You agree to note in writing, before picking up the rental car, any visible damage that is not described in the document. Otherwise, it will be considered that you have rented the vehicle as described in the document.
Unfortunately, we cannot accept claims regarding visible damage that was not reported at the time of pickup.
You must return the vehicle in the same condition as you received it. Any costs resulting from discrepancies between the vehicle's condition at pickup and drop-off will be added to the rental cost.
Fuel is not included in the rental price and is the client’s responsibility. The rental car is delivered with at least ¼ of a tank of fuel and must be returned in the same condition. If the rental car is returned with less fuel, the missing amount, as indicated on the dashboard, will be charged to the client at a rate of 2.2 Euros per liter. The oil and maintenance of the rental vehicle are the responsibility of the vehicle owner.
Use of the Vehicle
Usage Conditions
1. Usage Restrictions
• The vehicle cannot be driven outside of Romania without written authorization.
• The renter is responsible for any offenses committed during the rental period, and their personal data may be shared with state authorities (e.g., police, courts) upon request.
2. Responsible Driving
• The renter agrees to drive the vehicle in a prudent and responsible manner, in compliance with the traffic regulations as per the Road Code.
• Driving under the influence of alcohol, drugs, or any other substances affecting driving ability is prohibited.
• The vehicle must be used for its intended purpose, meaning passenger vehicles are primarily for transporting people, and utility vehicles are primarily for transporting goods.
3. Road Restrictions
• The vehicle should only be driven on national or European roads that are properly marked. Driving on unpaved or unmarked rural roads, forests, or forest roads is prohibited.
Vehicle Security
4. Document and Key Safety
• The renter must keep the vehicle keys and registration document with them when not in the vehicle. These documents should not be entrusted to anyone not listed in the rental agreement.
• Under no circumstances should the keys be left in the ignition when the vehicle is unattended.
• Failure to return the keys upon the vehicle’s return invalidates the theft insurance.
5. Security Measures
• When parking, even for short stops, the renter must lock and secure the vehicle, using the alarm and/or anti-theft system installed.
6. Repairs
• Repairs to the vehicle can only be carried out at authorized garages and only with the prior consent of the owner.
• Repair costs will be reimbursed based on an official invoice issued in the owner’s name, accompanied by the repair estimate.
Prohibited Uses
7. Prohibited Activities with the Vehicle
• The vehicle may not be used for:
• Sub-renting
• Transporting passengers for hire or for a fee, or carrying more passengers than specified in the vehicle’s registration certificate
• Participating in rallies, competitions, or tests
• Giving driving lessons
• Pushing or towing another vehicle (except for vehicles equipped with a tow bar, with a maximum load of 1000 kg)
• Driving on unsuitable roads or surfaces that may risk damage to tires or vehicle parts
• Committing an intentional crime
8. Baggage Transport
• Goods and baggage transported in the vehicle must be stored properly to avoid damage to the vehicle or risks to the occupants.
• It is prohibited to transport goods or luggage outside the vehicle, except for those specifically designed for this purpose and within the allowed size and weight limits.
In Case of Breakdown and Theft
9. Incident Reporting
• In case of an accident or theft, the renter must inform the company as soon as possible, providing the accident report or report issued by the authorities, along with the keys and documents of the vehicle.
• If the renter cannot provide police-issued documentation regarding the incident, they will bear all costs arising from that event.
10. Protection of the Owner’s Interests
• The renter agrees to protect the owner’s interests in the event of an accident or damage by taking all necessary legal actions and obtaining the personal data and addresses of the parties involved and witnesses.
Vehicle Maintenance
11. Inspection and Maintenance
• The renter will perform periodic checks (e.g., oil level, tire pressure) as part of normal and prudent use.
• Any warning signals on the dashboard should be addressed promptly, and in case of emergency, the company should be notified immediately.
12. Tires and Repairs
• The vehicle is equipped with five tires to meet legal traffic requirements. In case of damage, the renter must immediately replace the tire at their own expense with one of the same size, type, brand, and wear.
Assistance Services and Vehicle Replacement
13. Assistance in Case of Breakdown
• In case of breakdown or accident, the renter will receive assistance included in the rental price.
14. Vehicle Replacement and Insurance Difference
• The company will replace the vehicle (subject to availability) in case of a breakdown that cannot be repaired on the spot, provided the damage was not caused by the renter.
• If the vehicle cannot be replaced, the renter will receive a proportional refund for the rental cost for the duration the vehicle was unavailable.
15. Insurance Coverage and Liability
• In case of vehicle replacement, a new Hand-Over Sheet will be completed. If optional insurances are no longer valid, or the replacement vehicle is from a higher class, the renter will pay the corresponding difference for the optional insurance.
16. Liability Exemption
• The company is not liable for any losses suffered by the renter due to vehicle malfunction or damage, except for repair costs authorized by the company.
Rental Duration
1. Contract Duration
The user agrees to return the vehicle to the company on the date specified in the rental agreement. The maximum duration of a rental contract is 30 days, including extensions. For rental periods exceeding 30 days, a long-term rental agreement will be signed separately.
2. Rental Period Calculation
The rental period is calculated in indivisible 24-hour periods, starting from the moment the vehicle is made available. A 1-hour tolerance is allowed before a new 24-hour period is applied. If the vehicle is returned more than 1 hour late, an additional daily rental fee will be charged.
3. Extension of the Rental Contract
The rental period can be extended by setting up an appointment with an FMN Rent-A-Car agent and signing a new extension agreement.
4. Delivery and Return of the Vehicle
The delivery and return of the rental vehicle will be made at the location, date, and time specified by the client in the Car Rental Agreement, with no additional costs in the Bucharest area or Otopeni Airport. Delivery and return may also be arranged at other locations in the country, with the owner’s consent and based on an agreed-upon fee. The vehicle will be handed over to the client in good general condition, with no hidden or visible defects, and any information regarding the vehicle’s condition will be included in the agreement.
5. Vehicle Return
The rented vehicle must be returned at the location, date, and time specified in the agreement, along with the documents, accessories, and equipment. If the return is delayed by up to 1 hour, no additional charges will apply. After the rental period expires, the contract becomes void unless otherwise agreed.
6. Loss of Keys
If the vehicle is returned without the keys, the client will bear the cost of replacing the keys and returning the vehicle.
7. Forgotten Items
The company is not responsible for any items left inside the vehicle at the end of the rental agreement.
8. Termination of the Rental Contract
The contract is considered terminated upon the return of the vehicle, along with the keys and documents, and the return is official when the handover checklist is signed by both parties.
9. Contract Termination
The company may terminate the agreement immediately if the vehicle is confiscated or seized by the judicial authorities or at the request of the user.
10. Vehicle Pickup
Upon expiration of the rental period, the company reserves the right to pick up the rented vehicle without prior notice if the extension was not requested and accepted.
11. Warranty and Compensation
The client agrees to be responsible for and compensate for any expenses or value losses caused by:
• Improper use or maintenance of the rented vehicle, including damages to the engine, gearbox, or differential due to low oil levels or overheating.
• Damage to tires or inner tubes due to low or excessive tire pressure, punctures, sharp object impacts, or blowouts.
• Damage caused by improper use of the vehicle’s electrical system or other components.
• Damage due to driving on flooded roads.
12. Additional Fees for Specific Damages
• Lost keys: 50 EUR
• Damage to the radio/CD player: 150 EUR
• Use of adhesive tape on the bodywork: 50 EUR
• Loss of registration plate: 50 EUR
• Damage to wheels (scratches, bending, breakage): 100-150 EUR
• Other damages: Specific amounts depending on the type of damage.
13. Exceptions and Additional Conditions
Damages caused by the vehicle’s use for illegal purposes, under the influence of alcohol or drugs, accidents where the client attempts to escape responsibility, and theft of the vehicle due to the client’s fault are excluded from any compensation.
Insurance for Car Rentals
The rented car comes with CASCO insurance with a deductible ranging from 150 to 1000 euros.
The insurance is valid only when accompanied by the following documents. In case of an accident, it is mandatory to report it to the police, who will assess the damages and issue the necessary documents:
1. Police report with the signature and stamp of the police unit;
2. Confirmation of whether the driver was under the influence of alcohol;
3. Repair authorization with the name of the constating agent and the police unit’s stamp.
These documents are essential for validating the insurance and for repairing the vehicle. Without these documents, the client will be responsible for the full repair costs.
Civil liability
The client/authorized driver is covered by civil liability in the event of an accident. However, the client may be liable for damages not covered by the RCA insurance. Additionally, the client is responsible for damage or theft of the rented vehicle, up to a maximum amount. Details about the insurance included are available at the time of booking or at the rental office.
Traffic Fines
The client will bear all traffic fines resulting from non-compliance with Romanian laws, including fines received later (e.g., radar, parking, etc.). After the rental period expires, the client remains responsible for paying fines or other costs discovered later, even if the contract has expired.
Third Parties
If you use this website to make requests for or on behalf of a third party (such as a family member, travel companion, etc.), you are responsible for the accuracy of the information provided. Additionally, you must inform the third party about all the terms and conditions applicable to the services purchased through this website.
Each user who uses this website for or on behalf of a third party agrees to indemnify and protect the company against any losses, damages, or claims related to this. You are directly responsible for any request made, including full payment and performance obligations.

Jurisdiction
Any dispute between the merchant and the user arising from this agreement will be resolved by the courts in the location where the company is headquartered, unless otherwise agreed upon by both parties.
The client agrees that any changes or additions to the terms and conditions will be null and void if not agreed upon in writing by both parties.
